Terms of Use.

These terms of use apply to all mobile apps by viewmedia published on the Apple App Store and Google Play Store, in particular Wengla and NEO Blocks – hereinafter "apps". By installing and using an app you accept these terms. Not every feature described here is included in every app. This English version is provided for convenience; the German version is legally binding.

1. Provider

Your contractual partner for using the apps is viewmedia. The terms of the respective app store (Apple or Google) additionally apply to downloads and the billing of purchases.

2. License

• We grant you a non-exclusive, non-transferable, revocable right to use the app for private purposes on devices you own or control.
• Not permitted: copying, modifying, decompiling or redistributing the app, circumventing technical protection measures, automated access, and using modified versions of the app.
• All rights to the app, graphics, card sets, designs, texts, music and trademarks belong to viewmedia or the respective licensors.

3. Player account

• On first launch a player account bound to your device is created automatically (game service PlayFab). No email address is required. Optionally you can link the account to Game Center (iOS) or Google Play Games (Android) to use your progress on several devices.
• You choose a player name and an avatar. We may change or block names that are offensive, misleading, unlawful or impersonate other people.
• You are responsible for the use of your account. Trading accounts, passing them on to third parties, and running multiple accounts to the detriment of other players are not permitted.

4. Virtual currencies and content

• Our apps contain virtual currencies and content; in Wengla, for example, Wengs (table currency) and Wengcoins (required for online games and for buying card sets and designs), as well as unlockable card sets, designs and extras.
• Virtual currencies and content are not money and have no monetary value. They cannot be exchanged for money, paid out, transferred to other players or used outside the app. You do not acquire ownership, only a limited right of use within the app.
• You receive virtual currencies for free in the game (for example wheel of fortune, daily bonuses, ad videos, tournament prizes) or by paying in the shop. A purchase is not required to use the apps.
• We may adjust game values, prices, availability and functions of virtual content to keep the game balanced. Content already acquired remains usable as long as the app is operated.

5. In-app purchases and subscriptions

• Purchases are processed exclusively through the App Store or Google Play. The prices shown there including VAT apply; payment is made via your store account.
• Consumable content (for example Wengcoin packs) is credited to the player account immediately after purchase. Performance begins with the credit; a right of withdrawal expires with it insofar as you agreed to this at purchase.
• Non-consumable content (for example card sets, designs, ad-free) can be reactivated on the same store account via "Restore purchases".
• Subscriptions renew automatically at the stated price until cancelled. Cancel in the subscription settings of your store account at least 24 hours before the end of the current period.
• Refunds are governed by the rules of the respective store; requests must be directed to Apple or Google. Statutory rights remain unaffected.

6. Advertising

Some apps show advertising, including optional ad videos that grant a reward. If a video is aborted or no ad is available, there is no entitlement to the reward. Details on advertising partners are in the privacy policy.

7. Online play and code of conduct

• For online games your player name, avatar and moves are transmitted to the other players (Photon servers). We cannot guarantee constant availability of the online services.
• Team and world chat let you send text messages to other players. Offensive, abusive or unlawful messages are prohibited; they can be reported and muted locally by other players and lead to exclusion from chat or online play in case of violations.
• Prohibited: cheats, bots, manipulating the game flow, collusion between several accounts, exploiting bugs, and insulting, discriminatory or harassing behaviour towards other players.
• Violations may lead to warnings, exclusion from online features or permanent bans; unlawfully obtained virtual content may be removed.
• Leaving an online table early forfeits the stake of the current game according to the game rules.

8. Tournaments and events

The tournament terms of participation additionally apply to tournaments and events in Wengla. Prizes are virtual only; there are no cash prizes and no payout.

9. Age rating and simulated gambling

• The age rating shown in the respective store applies. Wengla contains elements of simulated gambling (for example wheel of fortune, lotto) without real money stakes and without cash winnings; Wengla is therefore rated 18+.
• Minors may use the apps only with the consent of a parent or guardian and may not make purchases without their consent.
• No money can be won in our apps. They are not gambling offers within the meaning of the German Interstate Treaty on Gambling.

10. Availability and changes

• We continuously develop the apps. Features, content and game rules may change with updates; online features may require the current app version.
• We may discontinue an app or individual online services with reasonable notice in the app or on this website. Paid content not yet consumed is then handled according to statutory provisions.
• We may amend these terms where required by new features, changes in law or other objective reasons. Material changes are announced in the app; the current version is always published on this page.

11. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. In cases of slight negligence we are liable only for the breach of essential contractual obligations and limited to the foreseeable damage typical for this kind of contract. For free features we are otherwise liable only for intent and gross negligence. We accept no liability for the loss of virtual content due to a device change without account linking, deletion of the app, or a breach of these terms.

12. Termination and account deletion

• You can stop using the app at any time by deleting it. You can permanently delete your player account in the app under Profile or Settings; all virtual currencies, content and rankings are forfeited. No refund is made.
• We may suspend or terminate accounts that violate these terms or have been inactive for an extended period.

13. Privacy

Information on the processing of personal data is in our privacy policy.

14. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection provisions of your country of residence remain unaffected. The European Commission provides a platform for online dispute resolution (ec.europa.eu/consumers/odr). We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
